The Prosecutor

When you are placed in a mental health care institution involuntarily due to the danger created by the crime committed and your mental incapacity, the prosecutor has the power to regularly ask for a review of the need to continue the involuntary placement. You may ask the prosecutor to submit a motion. It may be submitted at any time when your condition has changed and does not require involuntary treatment.

The court

The court in the region where your hospital is located must review your placement ex officio every six months. The court administration is also responsible for keeping a diligent record of the cases and to remind the court when the date for a review is approaching.

The Criminal Procedure Code explains who can initiate and conduct a review of your detention, how, and how often.
