Formal procedure
Although the international standards provide the review of your compulsory placement to be made in a formal court hearing, with your presence, the Bulgarian Criminal Procedure Code does not comply with them.
Presence and participation
The Bulgarian Criminal Procedure Code does not require explicitly you and your attorney-at-law to be present at the hearing. It only requires the court to take into account the opinion of the hospital where you are placed and the opinion of an expert-psychiatrist.
Appeal
The Bulgarian Criminal Procedure Code does not provide for any appeal procedure.
What human rights violation may there be?
If your rights are not respected in the decision making process, it may result in an unlawful or arbitrary continuation of your placement in a mental health care institution and violate the right to liberty and the security of a person.
