Under Bulgarian Constitution, your letters or telephone conversations may only be monitored or recorded with the permission of the judicial authorities when necessary for uncovering or preventing serious offences. However, all letters are opened to ensure that no unauthorised items are contained within. 

Privileged correspondence

important Conversations or written correspondence with your lawyer must not be monitored.

Your communication with state institutions, the Ombudsman or the courts should not be monitored. Read more about privileged correspondence.

Bulgarian law

According to Bulgarian law , prisoners’ correspondence is not subject to control, except when this is necessary for uncovering or preventing serious crimes. Permission for monitoring of letters or correspondence must be given by the court. The procedure is regulated by the Criminal Procedure Code.

How to complain

If you believe that your correspondence is being monitored without judicial permission  you should complain about this to the prosecutor’s office. Read more about how to complain.

If the aforementioned proceedings have been unsuccessful, you will later be able to complain about a potential violation of your rights in other national or international human rights institutions.
